These Terms of Service ("Terms") govern your access to and use of the web-based work-order and crew-scheduling application (the "Service") provided by Western Sky Energy LLC ("Western Sky," "we," "us," or "our"). Please read them carefully.
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the Service. The Service is made available to authorized users only.
The Service is a business-operations tool operated by Western Sky Energy LLC that allows authorized users to create and manage work orders, schedule technicians, record paid time off, view job assignments and locations, and coordinate field work. We may add, change, or remove features at any time.
The Service is intended solely for Western Sky Energy LLC's authorized personnel and other users we designate, for legitimate business purposes. You must be at least 18 years old and authorized by us to use the Service. You are responsible for all activity that occurs under your access credentials (including any shared access code or password), and you agree to keep those credentials confidential and notify us of any unauthorized use.

You are responsible for the accuracy, quality, and legality of the information you enter into the Service (including work orders, schedules, notes, and contact details). You represent that you have the necessary rights and authorization to enter any personal information you input. Information entered into the Service constitutes business records of Western Sky Energy LLC. Our handling of personal information is described in our Privacy Policy.
The Service, including its software, design, layout, text, and graphics, is owned by Western Sky Energy LLC or its licensors and is protected by intellectual-property and other laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for authorized business purposes only. No other rights are granted, and all rights not expressly granted are reserved.
The Service relies on third-party providers (such as hosting, database, content-delivery, and mapping services). We are not responsible for the availability, accuracy, or practices of third-party services, and your use of any linked third-party service (for example, a mapping provider) may be subject to that provider's own terms and policies.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any information displayed in the Service — including job-site locations, GPS coordinates, schedules, and contact details — is accurate, current, or complete. Users must independently verify job-site locations, directions, access, and safety information before relying on them in the field. The Service is a scheduling and recordkeeping aid and is not a substitute for professional judgment, safety procedures, or applicable regulations.
To the maximum extent permitted by law, Western Sky Energy LLC and its owners, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed one hundred U.S. dollars (US$100) or the amount you paid to use the Service in the twelve (12) months preceding the claim, whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Western Sky Energy LLC and its owners, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Service or your violation of these Terms or applicable law.
We may suspend, restrict, or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual-property rights, disclaimers, limitations of liability, indemnification, and governing law — will survive.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we will revise the "Last Updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Western Sky Energy LLC regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
